5280 Boatworks Limited
Website Policies
Our policies for customer information, online merchandise purchases, and use of this website.
Privacy Policy
1 Scope and Responsible Business
5280 Boatworks Limited, referred to as the Company, operates 5280Boatworks.com, referred to as the Site. This Privacy Policy describes how the Company handles personal information collected through the Site, online purchases, project requests, marketing subscriptions, and customer communications.
The Company uses information for the purposes described below. This policy is a notice of information practices; it is not a release of privacy rights or consent to unrelated processing.
2 Information Collected
The Company collects information supplied by customers and visitors, information generated through their transactions and communications, and technical information made available through website and business service providers.
Contact and account information includes names, email addresses, telephone numbers, billing and shipping addresses, account details, and communication preferences.
Transaction information includes ordered products, selected options, order history, payment status, receipts, shipping details, returns, refunds, and related correspondence. Payment credentials are processed by the payment provider used at checkout under its own privacy notice. The Company receives the transaction information that provider makes available for administering the purchase.
Project information includes vessel details, requested services, condition information, photographs, videos, quotes, approvals, work records, and customer correspondence.
Technical information may include IP addresses, browser and device information, referral information, pages viewed, and interactions with Site features. Collection depends on the website functions and optional tools enabled. Do not provide full payment card details, passwords, Social Security numbers, or other unnecessary sensitive information through ordinary forms or email.
3 Purposes of Use
The Company uses personal information to respond to inquiries, evaluate project requests, prepare quotes, perform authorized work, and coordinate customer service.
For merchandise orders, the Company uses information to process payment, arrange production and delivery, maintain order records, and handle returns, refunds, and warranty matters.
The Company also uses relevant information for accounting, fraud prevention, system security, protection of customer property, legal obligations, and the establishment or defense of claims. Technical information supports Site operation and, where optional analytics or measurement tools are enabled, evaluation of website use and marketing performance.
Marketing contact information is used to communicate about the Company's products, services, shop news, and projects when the customer has opted in or another lawful basis permits the communication. Consent required for a new or materially different use will be obtained separately.
4 Disclosures and No Sale of Customer Data
The Company does not sell customer data. This commitment includes customer email addresses, customer lists, order records, project records, and other personal information, whether exchanged for money or other valuable consideration. The Company does not furnish customer contact information to third parties for their independent marketing.
Information may be disclosed as reasonably necessary to providers supporting website hosting, commerce, payment processing, email delivery, storage, accounting, customer management, merchandise production, order fulfillment, shipping, and technical analytics or measurement. The information disclosed depends on the service. For example, a fulfillment provider or carrier may receive contact details, delivery information, and order contents needed to produce or deliver merchandise.
The Company uses Google Ads customer-list advertising. Customer contact information is provided to Google Ads for audience matching and advertising for the Company. Matching allows Google to compare supplied identifiers with its account information and identify an advertising audience. The Company obtains consent where required and honors applicable advertising opt-outs. An email subscription does not, by itself, constitute consent to every advertising use.
Project suppliers, subcontractors, transport providers, insurers, and professional advisers may receive information needed for an authorized project or legitimate business matter. The Company may also disclose information to comply with law or legal process, investigate misuse, protect rights or safety, or resolve a claim.
Relevant records may be transferred in a lawful business transaction, subject to applicable privacy obligations and restrictions on marketing opt-out records. Such a transfer does not authorize unrestricted reuse of a customer mailing list.
5 Email and Text Message Choices
Marketing emails provide an unsubscribe method. Customers may also opt out by emailing info@5280Boatworks.com. The Company honors marketing email opt-outs within 10 business days and retains limited suppression information to prevent unwanted re-enrollment.
Necessary order, billing, scheduling, safety, warranty, and project communications may continue independently of marketing email preferences. A promotional message is not treated as a necessary service message merely because the recipient is a customer.
Marketing texts, if offered, require a separate consent process. Providing a telephone number during checkout or submitting an inquiry does not, by itself, authorize marketing texts. A recipient may revoke text consent by replying STOP or contacting the Company through another reasonable method. The Company will stop messages covered by the request and arrange another appropriate contact method for active business matters. Message and data rates may apply.
Mobile numbers and text-message consent records are not provided to third parties for their promotional purposes. Providers may process them to support authorized communications. This privacy notice does not replace program-specific SMS terms or any consent required for automated calls or texts.
6 Cookies and Similar Technologies
The Site uses cookies and similar technologies for functions such as shopping carts, checkout, security, and preferences. Optional analytics or measurement tools, where enabled, may collect technical information about Site activity. Embedded media or third-party links may involve services with their own privacy notices.
Browser settings and any Site cookie preference controls can be used to manage available choices. Restricting essential technologies may affect checkout or other functions. Consent will be requested where legally required. The Company's no-sale commitment applies to disclosures involving website technologies as well as information supplied directly by a customer.
Privacy requests, including applicable requests to opt out of targeted advertising, may be submitted by email to info@5280Boatworks.com or by telephone at (720) 251-2839. Where required, the Company recognizes qualifying universal opt-out signals, including Global Privacy Control, for the processing covered by those signals.
7 Project Photographs and Submitted Materials
The Company uses submitted photographs and project materials to evaluate requests, document condition and authorized work, and communicate with customers. Public marketing use of an identifiable customer project is governed by the applicable separate permission or media release. An order, inquiry, or acceptance of this policy does not grant unrestricted permission to publish customer materials.
8 Retention and Security
The Company retains information for the period reasonably needed for its stated purpose and applicable tax, accounting, warranty, insurance, legal, and dispute obligations. Unconverted inquiries are reviewed for deletion when no longer needed. Limited consent and suppression records may be retained to document and honor communication choices. A preservation obligation may require longer retention.
The Company uses reasonable administrative, technical, and physical safeguards appropriate to its operations and the information involved. Information no longer needed is securely disposed of or de-identified, subject to required retention and preservation. No system can guarantee complete security. The Company provides incident notices when required by law.
9 Privacy Requests and Colorado Rights
To request access, correction, deletion, a copy of information, or a change in privacy preferences, email info@5280Boatworks.com or call (720) 251-2839 and identify the request as a privacy request. The Company may take reasonable steps to verify identity or authority and may retain information required for an active transaction, legal obligation, claim, or other lawful exception. Verification will be proportionate to the request; customers are not required to create a new account to exercise rights under the Colorado Privacy Act.
Where the Colorado Privacy Act applies, eligible consumers may confirm processing, access, correct, delete, and obtain a portable copy of personal data, and opt out of sale, targeted advertising, and profiling used for decisions with legal or similarly significant effects, subject to statutory exceptions. Authorized agents may submit applicable opt-out requests with evidence of authority.
For requests governed by that Act, the Company responds within 45 days. When reasonably necessary, that period may be extended by an additional 45 days, with notice and reasons provided during the initial period. A denial will explain the reason and appeal process.
To appeal, email the same address with the subject Privacy Appeal and identify the decision. The Company responds to an applicable appeal within 45 days, subject to a permitted extension of up to 60 additional days with timely notice and reasons. An appeal response will explain how to contact the Colorado Attorney General with concerns about the result.
The Company does not discriminate against a person for exercising applicable privacy rights. Rights under another state's law will be evaluated under that law when applicable.
10 Children and Policy Changes
The Site and the Company's services are directed to adults. The Company does not knowingly collect personal information from children under 13. A parent or guardian who believes a child has supplied information may contact the Company for review and appropriate action. Other protections for minors apply when triggered by the relevant law and processing activity.
The Company may revise this policy and update the revision date. Changes apply prospectively as permitted by law. Publication of a revised policy does not replace consent required for a materially different use of information.

Return and Refund Policy
1 Scope
This Return and Refund Policy applies to merchandise purchased through 5280Boatworks.com. References to the Company mean 5280 Boatworks Limited. Boat restoration, repair, maintenance, storage, and consulting services are governed by the applicable service agreement, quote, or work authorization.
2 Made to Order Merchandise
Products identified in their listings as made to order, printed on demand, customized, or personalized are produced for the customer's order. The Company does not accept returns or exchanges of those products for a change of mind, a size or color selected incorrectly by the customer, or an error in customer-supplied personalization.
This restriction does not apply to defective goods, shipping damage, an incorrect item supplied by the Company, or merchandise that materially fails to conform to its description. Review the product description, size chart, selected options, and delivery address before ordering.
The exclusions in this section apply only to the identified made-to-order, printed-on-demand, customized, or personalized products. Return terms for other merchandise will be stated separately before purchase.
3 Product and Fulfillment Problems
For damaged, defective, misprinted, or incorrectly supplied merchandise, email info@5280Boatworks.com as soon as the problem is discovered. To qualify for the Company's voluntary fulfillment-claim process, submit the request within 30 calendar days after delivery. Include the order number, a description of the problem, and photographs of the item and relevant packaging when reasonably available.
After reviewing the claim, the Company will provide a replacement or refund for a verified product or fulfillment error. If an appropriate replacement is unavailable or cannot be supplied within a reasonable time, the Company will refund the affected merchandise. A replacement will not be imposed in place of a refund where the customer is legally entitled to a refund.
Normal variations within disclosed product specifications or production tolerances are not necessarily defects. This provision does not excuse a material difference from the listing, an incorrect size supplied by the seller, or failure to meet an express product representation.
The 30-day period governs the voluntary fulfillment-claim process. It does not limit applicable warranties or statutory remedies. For a defect discovered later, contact the Company promptly after discovery so the claim can be evaluated under the applicable warranty and law.
4 Return Authorization and Costs
Obtain return instructions before mailing merchandise. The Company will identify the correct return location and confirm whether a physical return is required. Merchandise must not be sent to the shop or a production partner without those instructions.
If a return is required for a verified product or fulfillment error, the Company will provide a prepaid return method or reimburse reasonable return shipping costs approved in advance. No restocking fee applies to that return. Retain the item and packaging until the Company confirms whether they are needed. Discontinue use of an item that presents a safety concern.
5 Order Changes and Cancellations
Request a change or cancellation immediately by emailing info@5280Boatworks.com with the order number. The Company will cancel and refund an order if production or fulfillment can still be stopped. A made-to-order item that has entered production may no longer qualify for voluntary cancellation or modification.
Production status does not eliminate cancellation or refund rights arising from a shipment delay, nonfulfillment, defective goods, or other circumstances covered by law. Shipment-delay procedures are described in the Store Terms of Sale.
6 Delivery Problems
Contact the Company if an order does not arrive or is marked delivered but has not been received. The Company will review the shipment with the production partner or carrier and assess the appropriate remedy. A delivery scan is relevant evidence but does not conclusively resolve a delivery dispute.
If an incorrect or incomplete address supplied by the customer results in a returned shipment, the Company will disclose any proposed reshipment charge before arranging reshipment. The customer will not be charged an additional amount without agreement.
7 Refunds and Customer Rights
The Company will issue approved refunds promptly to the original payment method when available and within the period required for the applicable transaction and payment method. Financial institutions may require additional time to post a credit. Store credit will not replace a required monetary refund without the customer's agreement.
A refund for a verified product or fulfillment error includes the affected purchase price, associated refundable taxes, and shipping charges attributable to that error. Government-imposed fees are refunded only as permitted or required by the law governing the fee. Cancellation of an unshipped order for nonfulfillment or a qualifying shipment delay will include the amounts required by law.
This policy does not exclude applicable warranties or remedies, restrict lawful payment disputes, or condition a remedy on the Company's ability to obtain reimbursement from a supplier.

Store Terms of Sale
1 Application of These Terms
These Store Terms of Sale govern merchandise orders placed through 5280Boatworks.com. The seller is 5280 Boatworks Limited, referred to as the Company. By submitting an order through a checkout process that presents these Terms and requests acceptance, the customer agrees to these Terms and the Return and Refund Policy presented for that purchase.
Product-specific terms disclosed before purchase also apply. A specific product description or accepted order term controls over an inconsistent general description. No provision overrides a consumer right that cannot lawfully be waived. The Privacy Policy describes information handling and does not constitute blanket consent to marketing or unrelated data use.
Boat services, project deposits, and work performed on customer property are governed by their separate agreements. These Terms do not amend an approved quote, project budget, credit, labor waiver, or service warranty.
2 Eligibility and Order Information
The customer must have legal capacity to enter into the purchase or the necessary authorization to act for another person or organization. The customer must provide accurate contact, billing, and delivery information and use an authorized payment method.
Before ordering, review the item, quantity, size, color, personalization, and delivery address. Notify the Company immediately of any error. Changes are subject to the order's production and fulfillment status and the Return and Refund Policy.
3 Product Descriptions
The Company makes reasonable efforts to provide accurate descriptions, images, and specifications. Product photographs or mockups illustrate the listed item. Display settings and production methods can affect appearance, but reasonable variations must remain consistent with the listing and any disclosed tolerances.
Made-to-order, printed-on-demand, customized, or personalized status will be identified in the listing. Such status does not exclude remedies for defective or nonconforming merchandise. Product descriptions and express representations are not displaced by a general website disclaimer.
4 Prices and Payment
Prices are stated in U.S. dollars unless another currency is expressly identified. Applicable shipping charges, taxes, and disclosed fees are shown before the customer submits the order. Payment is processed through the payment provider selected at checkout and is subject to authorization and legitimate verification procedures.
The Company may correct a material listing or pricing error. If a correction affects an order already submitted, the Company will notify the customer and either obtain agreement to the corrected order or cancel the affected merchandise and refund the amounts paid. A revised price will not be charged without the customer's agreement.
5 Order Processing and Availability
An automated confirmation records receipt of the order. It does not alter the shipment and refund obligations that arise when the Company receives a properly completed order. The Company may reject or cancel an order for a legitimate reason, including unavailable merchandise, unauthorized payment, suspected fraud, or a material listing error. The Company will notify the customer and promptly refund payment for merchandise it will not supply.
Production, payment, fulfillment, and shipping providers may assist the Company. Their participation does not transfer the Company's obligations as seller to the customer or require the customer to seek a remedy exclusively from a provider.
6 Production and Shipment
Production time is separate from carrier transit time. The applicable shipment estimate or commitment is stated in the product listing, checkout, or order communications. Items may be produced at different facilities and shipped separately.
The Company will have a reasonable basis for each stated shipment timeframe. If no shipment timeframe is clearly stated, the Company will ship within 30 days after receipt of a properly completed order, unless a different period is agreed through a lawful delay process.
If the Company cannot ship within the applicable period, it will provide a timely delay notice, a revised shipment date when reasonably available, and the option to cancel and receive a prompt refund. The Company will obtain any consent required to continue the order. If the customer declines the delay, the required consent is not obtained, or the merchandise cannot be supplied, the Company will cancel the affected unshipped merchandise and provide the required refund.
Carrier delivery estimates are estimates unless a delivery commitment is expressly stated. Production interruptions, carrier disruptions, and events outside the Company's control do not eliminate mandatory cancellation or refund rights.
7 Returns and Delivery Claims
The Return and Refund Policy governs voluntary cancellation, change-of-mind restrictions, product claims, authorized returns, and refunds. For a delivery problem, contact the Company so it can review the shipment and determine the appropriate resolution. These Terms do not impose a blanket transfer of all shipping risk to the customer when a package is handed to a carrier.
8 Warranties and Product Use
Express warranties accompanying a product and warranties arising under applicable law remain in effect. The Return and Refund Policy is a claim-handling process, not a disclaimer of those warranties. These Terms do not establish a new warranty duration or make a replacement the customer's exclusive remedy.
Follow product descriptions, care instructions, and safety warnings. Merchandise is not represented as certified safety equipment or suitable for a particular marine application unless the listing expressly makes that representation.
9 Communications and Customer Content
The Company may send order confirmations, invoices, shipment notices, and other communications needed to administer the purchase. Optional marketing preferences are handled separately. Providing a telephone number or placing an order does not, by itself, authorize marketing text messages.
For customer-supplied artwork or personalization, the customer must have authority to supply the material. The customer permits the Company and its production partners to use it to fulfill and support the authorized order. This limited permission does not transfer ownership or authorize unrelated advertising use. Nothing in these Terms prohibits honest customer reviews or requires transfer of intellectual property rights in those reviews.
10 Governing Law and Administration
Colorado law and applicable federal law govern these Terms, without depriving a consumer of mandatory protections under another applicable jurisdiction's law. Proceedings must be brought in a court with proper jurisdiction and venue.
The version presented and accepted when the order is placed governs that order. Later revisions apply prospectively. If a provision is unenforceable, the remainder continues in effect to the extent it can operate lawfully. Nothing in these Terms releases fraud, intentional misconduct, gross negligence, or liability that cannot be excluded by law.

Website Terms of Use
1 Scope and Related Agreements
These Website Terms of Use govern use of 5280Boatworks.com, operated by 5280 Boatworks Limited, referred to as the Company. They describe permitted use of the website, its content, and inquiry features.
Merchandise purchases are governed by the Store Terms of Sale and Return and Refund Policy presented during checkout. Boat services are governed by the applicable accepted quote, work authorization, and service agreement. Those transaction-specific agreements control their subject matter. These website provisions do not amend a customer's approved scope, budget, payment terms, credit, waiver, or warranty.
The Privacy Policy describes personal information handling. A website visit or inquiry does not constitute consent to every use of information described in that policy. Where an agreement or consent requires affirmative acceptance, the Company will use a separate acceptance process.
2 Project Requests and Service Information
A project request is an inquiry. Submitting a form does not authorize work, establish a final quote, reserve a start date, or create a guarantee that the Company will accept the project. Scope, price, scheduling, and authorization are established through the applicable project process.
General service descriptions, project examples, and educational content do not establish the condition, seaworthiness, legal compliance, or fitness of another vessel. A specific inspection or assessment may be needed before making a safety-critical or project decision. Website content is not a substitute for legal, tax, engineering, or other professional advice appropriate to the matter.
3 Permitted Use
Use the website lawfully and provide information you are authorized to submit. Do not impersonate another person, misrepresent authority over a vessel, introduce malicious code, interfere with website security, or attempt to obtain nonpublic records or credentials.
The Company may restrict access reasonably necessary to protect the website, customer information, or lawful operations. Such action does not excuse obligations under an existing customer agreement or eliminate access to a remedy required by law.
4 Website Content and Intellectual Property
The Company's original branding, designs, photographs, and written content are protected by applicable intellectual property law. Other material is owned by its respective rights holder or used with permission. References to a manufacturer or another business do not imply endorsement unless expressly stated.
Visitors may view the website and retain reasonable copies to evaluate the Company's services or products. Commercial reproduction, distribution, or reuse requires the rights holder's permission unless the use is otherwise permitted by law.
5 Submitted Information and Project Media
By submitting a project request, photograph, or other material, the sender permits the Company to receive, retain, review, and use it to respond to the request and perform any subsequently authorized service. The sender must own the material or have authority to provide it.
This limited permission does not transfer ownership of customer materials or authorize public marketing use of an identifiable customer project. Public use requires the applicable separate permission or media release. The Company handles personal information under its Privacy Policy.
Do not submit unnecessary payment credentials, government identification numbers, passwords, or other sensitive information through ordinary forms or email. These provisions do not prohibit honest reviews or require ownership transfer of customer opinions.
6 Third Party Services and Links
The website may contain links or embedded services operated by third parties. Their terms and privacy notices govern their services. The Company does not control an external website's content or availability, and a link does not constitute a general endorsement.
This provision does not eliminate responsibilities the Company has for its own disclosures, selected service providers, or accepted customer transactions.
7 Website Availability and Limitations
The Company makes reasonable efforts to maintain accurate website information and may correct errors or update content. General website information is provided on an available basis without a promise of uninterrupted access or suitability for every proposed use.
These website limitations concern general information and access. They do not disclaim product warranties, override express representations in a transaction, limit privacy obligations, or excuse fraud, intentional misconduct, gross negligence, or other liability that cannot lawfully be excluded. No release of responsibility for authorized boat work is created by these Terms.
8 Governing Law and Changes
Colorado law and applicable federal law govern these Terms, subject to mandatory protections under any other applicable law. A dispute may be brought in a court with proper jurisdiction and venue.
The Company may revise these Terms and update the revision date. Changes apply prospectively and do not retroactively amend an accepted project or purchase agreement. Any change requiring affirmative acceptance will be presented through the appropriate acceptance process.
